The Broker-Lawyer Committee met October 10 and recognized new committee members, reviewed comments received about recent proposals, and decided to withdraw other possible changes for the committee to further consider.

New BLC Appointees Welcomed

The Broker-Lawyer Committee is composed of six attorney members who are appointed by the State Bar of Texas, six members appointed by TREC, and one public member appointed by the Governor. Members serve six-year appointments, except for the public member who serves a two-year term. New appointees were introduced at the October meeting:

  • Kandi Luensmann, broker member
  • Kristen Porter, attorney member
  • Kenneth Vall, attorney member

Co-Chair and Broker Member Ron Walker was reappointed to serve another term.

3 Forms Recommended for Adoption

BLC recommends the Commission adopt the temporary residential lease forms and the flood plain notice for use with leases during its next meeting in November. These forms were up for proposal at the August meeting.

Temporary Lease Forms

Effective September 1, 2025, Senate Bill 2349 excepts temporary residential leases and short-term leases from the obligation to provide the landlord notice related to flooding. TREC has updated the Landlord’s Floodplain and Flood Notice and its two temporary residential lease agreements: the Buyer’s Temporary Residential Lease and Seller’s Temporary Residential Lease.

Other Proposals Withdrawn for Now

After reviewing public comment and further discussion of additional contract changes that may be needed, the committee decided to request the Commission withdraw from consideration other remaining proposals that were made at the August TREC Meeting. This includes updates to Paragraph 12, the page 10 disclosure, proposals related to disclosing groundwater and surface water rights, and new disclosures related to conservation easements, windstorm, and other insurance disclosures. They plan to continue discussion about this and the other form proposals at their next meeting, planned for two days in January 2026.
