
At its April 10, 2026, meeting, the Broker-Lawyer Committee (BLC) reviewed over 70 comments on the proposed updates to contract forms. After discussion, the committee approved non-substantive several revisions aimed at improving clarity and usability, including:
- Adding a second line for phone numbers in Paragraph 21 and clarifying the notice language.
- Updating terminology, including replacing “Water Notice” with “Seller’s Water Disclosure”, retitling the new water disclosure form, and clarifying language regarding seller obligations.
- Removing Paragraph 7I entirely from the Residential Condominium Contract form.
- Revising broker-related language, including changing “Broker Information” to “Broker Contact Information” and emphasizing language through formatting updates.
- Updating some of the language in the Broker’s Fee section of the Farm and Ranch Contract.
- Revising the language in Paragraph 20B to make the language more general and to remove language related to a buyer paying associated charges.
Following these changes, the committee voted to recommend that the Commission adopt the forms originally proposed at its February 9, 2026, meeting, incorporating the non-substantive revisions discussed.
Ongoing Working Group Efforts
Working groups reported on their progress and received feedback for continued development:
- Reinstatement/Expiration Working Group—Opened discussion exploring when a reinstatement of contract form may be appropriate. The committee provided input for further refinement.
- Style Working Group—Shared a revised format using the Third-Party Financing Addendum as a model.
Additionally, a new working group was formed to review and standardize key terms such as “notice,” “deliver,” and “provide” across contract forms to promote consistency.
Deferred and Referred Topics
The committee deferred action on several items for future consideration, including:
- Adding walk-throughs as a permitted access purpose.
- Standardizing headers across voluntary and mandatory forms.
- Updates to the Lead-Based Paint Addendum.
- Mold remediation certificate notices.
- Amendment form language regarding option fee.
- Termination dates or specific time of termination in Seller’s Temporary Lease.
Other topics were referred to working groups, including:
- Hyperlinks in notices and title commitments (Notice Working Group).
- Lapse clauses (Reinstatement/Expiration Working Group).
- Non-Realty Items Addendum revisions (Style Working Group).
The committee also addressed broader issues, including time-of-the-essence clauses and considerations related to transaction coordinators. These discussions will continue at future meetings.
