TREIC Reviews New Relationship Termination Form, Recommends a Rule Change for Proposal

The Texas Real Estate Inspector Committee (TREIC) met October 18 and reviewed a new tool to aid in filling out the Property Inspection Report Form, a new form that will inform TREC when a real estate inspector relationship is terminated, and items for the 88th Texas Legislature.

Broker Responsibility Group Proposes New Rule on Response Times, Adding Oversight to Sales Agent’s First-Time Brokerage Activity

The Broker Responsibility Working Group (BRWG) met July 13 and acted on two proposals related to broker oversight and sales agents’ response times.

Proposed Rule

BRWG proposed a new rule, 535.157, that requires a broker or sales agent to respond to their principal, a broker or sales agent representing another party to a real estate transaction, or an unrepresented party to a real estate transaction within two calendar days.

Contribute to Important Research on Wholesaling in Texas

The Texas Real Estate Commission (TREC) is conducting a study on wholesaling and seeking input from consumers, wholesalers, and license holders. Wholesaling is a model where a person enters into a contract to buy real estate and then sells their contractual interest in the property to a third party prior to closing. Take this anonymous survey to help the agency as it examines wholesaling practices and consumer protection measures. The survey should take about five minutes to complete.

 

New Filing Requirements for HOAs

During the 87th regular session, the Texas legislature passed SB 1588 related to Home Owner Associations (HOAs). This bill requires TREC to establish a database to accept management certificates from HOAs. This bill does not give TREC the authority to license or register HOAs, and TREC does not have enforcement jurisdiction of HOA activities.
