22 TAC §535.1, Definitions

The change to 22 TAC §535.1 is made to implement statutory changes enacted by the 89th Legislature in SB 1968, which becomes effective January 1, 2026. SB 1968 requires that associated brokers—also defined by the bill—provide the Commission the name of the broker they associate with and allows the Commission, through rulemaking, to provide notice of a complaint to another license holder associated with the respondent. As a result, the same definition found in SB 1968 is added to the §535.1 and the subsections are renumbered accordingly.

TREC Meeting: Form Change Proposals, Comment on Broker Education and Experience Requirements

The Texas Real Estate Commission met August 11, marking the first meeting led by newly appointed Chair Mark Woodroof, of Houston, and for Broker Members Kristi Davis, of Carrollton, and J.B. Goodwin, of Austin (pictured below in order). It started with commissioner appointments to various committees and honoring outgoing Broker-Lawyer Committee members.

The Texas Real Estate Broker-Lawyer Committee met for more than six hours on June 13, covering topics ranging from legislative session outcomes and whether they affect TREC forms, considered a draft water rights notice, and discussed how license holders have implemented the changes to Paragraph 12.

Meet TREC’s New Chair and Two Broker Members

The Texas Real Estate Commission (TREC) welcomes two new commissioners and a new chair. Governor Greg Abbott appointed Mark Woodroof (pictured left) as chair. He also appointed J.B. Goodwin and Kristi Davis to the Commission with terms set to expire January 31, 2031. They were later confirmed by the Texas Senate.

Woodroof, who has served on the Commission as a broker member since 2021, was appointed on May 6, 2025, to serve as chair.

22 TAC §535.191, Schedule of Administrative Penalties

The amendment to §535.191(c)(8) is made as a result of statutory changes enacted by the 89th Legislature in SB 1968, which becomes effective January 1, 2026. SB 1968 adds a requirement for a written agreement with a prospective buyer of residential real property to Chapter 1101 of the Texas Occupations Code. The bill also adds the Commission may take disciplinary action if there is a violation of this requirement. In accordance with §1101.702, this new violation is added to subsection (c)(8)—the $100 - $1,500 per violation per day penalty tier.
