Agenda Item 1 Call to Order
ACTION: Chair Brown called the meeting to order at 10:01 a.m.
Members present: Chance Brown, Bob Baker, Holly Hightower, Yazmin Perez, Brian Sales, Pam Titzell, Ty William
Bill Roth and Socar Chatman-Thomas joined the meeting shortly after the meeting began.
Commission liasions present: Leslie Lerner, Barbara Russell

Agenda Item 2 Welcome and Housekeeping

Agenda Item 3 Public comment, including any written public comment received, on non-agenda items
ACTION: Chair Brown will work with General Counsel Burgess to formulate a response and will look at this again after Rule Review is completed.

Agenda Item 4 Discussion and possible recommendation regarding 22 TAC §535.56, Education and Experience Requirements for a Broker License and forms adopted by reference
No changes were requested.

Agenda Item 5 Discussion regarding previously written draft rules regarding property management
ACTION: General Counsel Burgess to formulate a list of ideas and questions based on discussion to include: possible separate IABS form for property management and possible separate license/certification or designation checkbox on website for property management for agent and broker with a required class.  Things that can be done now include: an update to 30 hour property management course outline for ESAC and consumer outreach.

The committee took a break at 11:25 a.m.
Chair Brown reconvened the meeting at 11:35 a.m.

Agenda Item 6 Discussion and possible action to recommend new rule to require sales agents respond to license holders representing other parties in real estate transactions within two calendar days
ACTION: Socar Chatmon-Thomas, seconded by Ty Williams, moved to direct staff to create a rule with verbiage similar to §535.2(j) for sales agents to be presented to full Commission for possible proposal.  The motion was adopted by unanimous vote.

Agenda Item 7 Discussion regarding mentorship of brokers and sales agents
ACTION: General Counsel Burgess to formulate a list of items based on discussion to include: number of transactions vs. time frame, possibility of changing wording in rule from first transactions to certain number of transactions, possibility of making the mentor a delegated supervisor, possibility of contracts being reviewed by a mentor prior to execution, and the possibility of a formal mentorship. Chair Brown to also get feedback from the full Commission at the February Commission meeting.

Agenda Item 8 Update regarding ESAC's upcoming review of qualifying education course content
related to the role and responsibilities of the broker and agent
ACTION: Chair Brown to discuss this as a part of an ESAC working group and will report outcome at next meeting.

Agenda Item 9 Discussion and possible action regarding future agenda items and meeting dates
Suggested meeting date: Wednesday, April 13, 2022, at 10:00 a.m.
Alternate dates: Tuesday, April 12, 2022, or Thursday, April 14, 2022
ACTION: The next meeting is scheduled for Wednesday, April 13, 2022.
