ACTION: The meeting was called to order at 1:00 p.m.

Agenda Item 3 Discussion and possible action to amend the June 9, 2020, meeting minutes

No amendments were requested.

Agenda Item 4 Is there any public comment on a non-agenda item?

No comments were given.

Agenda Item 5 What balance should be struck between education and experience (and college degree vs. no college degree)?

Agenda Item 6 (time permitting) Should Texas adopt a new real estate broker mentorship/internship/apprenticeship program?

ACTION: The committee decided by consensus to email their ideas regarding education requirements, experience requirements, and broker apprenticeship to general counsel and also asked general counsel to research broker apprenticeship from past Broker Responsibility Working Group meetings to review at their next meeting.

Agenda Item 7 (time permitting) Should Texas allow real estate broker reciprocity?

a. What about a “temporary out of state registrations for commercial transaction”?
b. What about military spouses who are also a real estate brokers in another United States jurisdiction? (What does “substantially equivalent” mean for a real estate broker under the military spouse law and rule)?

No action was taken.

Agenda Item 8 Other items (discuss at this or a future meeting, time permitting)

a. How should Texas enforce Rule 535.2(i)(5) regarding a broker educating a sponsored sales agent who engages in a type of real estate brokerage activity for the first time?
b. What recommendations from the 2018-2019 Broker Responsibility Working Group should be carried forward from this group?
c. Should the number of hours of continuing education of a broker be increased for a renewal?
d. Should an applicant for a broker’s license be required to disclose lawsuits, even if settled? (compare to unpaid judgments in 535.52(b)(8))
e. Does the working group recommend any changes regarding “minimum service requirements in relation to service fees”?

No action was taken.

Agenda Item 9 Discussion and possible action regarding comments received on other broker responsibility working group items since the last meeting

ACTION: The committee decided by consensus to refer the comment received to the Education Standards Advisory Committee for review.

Agenda Item 10 What future meeting agenda items would you like?

ACTION: The committee decided by consensus to focus on education and experience requirements.

Agenda Item 11 When is the next meeting?

Suggested date per planning schedule: Wednesday, October 14, 2020, at 10:00 a.m.; Alternative dates: Tuesday, October 13, 2020, or Thursday, October 15, 2020.

ACTION: The next meetings are scheduled for September 9, 2020, at 1:00 p.m. and October 14, 2020, at 1:00 p.m.
