Maintain Your Residential Service Company License
ATTENTION: Effective September 1, 2021, Residential Service Company regulation will transition to the Texas Department of Licensing and Regulation. If you intend to file an application, please contact TREC before doing so at 512-936-3049.
As a licensed Residential Service Company (RSC) you must submit an annual report and a mid-year report to the Commission. In addition, you must submit an application to amend your contracts and the charges and discounts associated with your contracts.
What do we have to do to keep our RSC license in good standing with TREC?
Submit an Annual Report
Your annual report must be submitted no later than February 1st of each year. The Annual Report by Residential Service Company must cover the preceding calendar year and will need to be verified by at least two of the RSC’s principal officers. Make sure you review the annual report form as there are documents that may be required with submission of your report.
You are also required to submit financial statements no later the April 1st. If your company has assets totaling over $5 million, your financial statements must be audited or reviewed.
File your Annual Report
You will need to perform the following steps to complete your report:
- complete the required Annual Report By Residential Service Company
- clearly identify all required documentation to correspond with the number of questions to which it refers
- submit the required fee.
You can submit all or some of your supporting documentation by email. Before submitting your annual report by email, you must contact the Commission for further instructions.
Please be aware that you will still have to submit a hard copy of the annual report form and the fee by mail.
Submit a Mid-Year Report
Your mid-year report must be submitted no later than August 1st of each year. The Mid-Year Report by Residential Service Company must cover the months of January through June, and must include all the required information on the form.
Before you submit your report, be sure you have included all of the required documents and information.
You can submit all or some of the supporting documentation by email. Before submitting your mid-year report by email, you must contract the Commission for further instruction.
File an Application to Approve Evidence of Coverage/Schedule of Charges
You must receive prior approval from the Commission before issuing new or amended contracts. You must submit an Application to Approve Residential Service Contract and the required fee for each new contract or amended contract. Before filing your application, you should carefully review the instructions so that you include all of the required documents and information.
Any revisions to previously approved charges and discounts associated with your contract must be filed with the Commission, and if you do not carry a reimbursement insurance policy, they must be approved before you can offer the revised charges or discounts. You must submit an Application to Approve/File Schedule of Charges and the required fee for the proposed charges and discounts associated with each new contract and for revisions to charges or discounts for an existing contract. Before filing your application, you should carefully review the instructions so that you include all the required documents and information.
File a Residential Service Company Notice of Modification
If there is a change of mailing address or other contract information or a change in the company's ownership or officers, you must file a Residential Service Company Notice of Modification form.
Notice of Affiliation
If you wish to issue and administer contract in affiliation with another company, you must give the Commission no less than 30 days written notice before doing so. You must also provide copies of the contract(s) and any advertising to be issued or administered by the affiliate.
