  • Mortgage Fraud Task Force Dissolved, But Interagency Cooperation Remains

    Governor Abbott Has Signed SB 526

    SB 526 abolishes the Residential Mortgage Fraud Task Force established under the Government Code. However, the bill maintains the ability of those agencies who were members of the task force to share information related to mortgage fraud and also protects the confidentiality of any information shared.

    Governor Abbott Has Signed SB 2212

    SB 2212 makes changes to the regulations governing advertising for real estate brokers and sales agents.  

    It removes the current requirement that the advertiser be identified in each advertisement as a broker or agent, and clarifies that an advertisement is misleading if it fails to include the name of the broker, or if it implies that a sales agent is responsible for the operation of a brokerage.

    Memorial Day was the last day of the 85th Legislative session.   • Reporting Visible and Present Indications of Adverse Performance in a Foundation

    Section 535.228(a) of the Texas Administrative Code (Foundations) requires an inspector to render a written opinion as to the performance of the foundation. Many inspectors understand this to mean one of two things; the foundation is either performing or it is not performing. But sometimes the inspector is unable to determine this with sufficient confidence.
