Job Summary:

The Legal Assistant works in the Enforcement Division. This position assists attorneys with case management, reviews and analyzes new complaints against license holders and other Texas Real Estate Commission (TREC) regulated persons and entities, researches and applies applicable statutes and rules and drafts orders and petitions and other appropriate documents.

Job Duties:
  • Review and analyze consumer complaints to determine jurisdiction, alleged violations, and appropriate investigative action
  • Prepare appropriate response, request more information, or initiate investigation
  • Apply the appropriate law and agency policies in analyzing and resolving complaints
  • Draft letters and documents that are free of grammatical and punctuation errors
  • Prepare letters, memos, reports, and documents related to contested matters as assigned following the correct template
  • Assist attorneys with successful case management
  • Review case status for all complaints on monthly case activity report and updates supervisor and investigators as applicable
  • Complete assigned work in a timely and efficient manner
  • Perform other tasks as assigned.
Minimum Qualifications:
  • Bachelor’s degree from an accredited four-year college or university. Experience can substitute for education on a year for year basis.
  • Three (3) years of relevant program or office work experience.
  • Experience working with the public.
Preferred Qualifications:
  • Real estate experience and/or current Texas Real Estate license. (License must be placed on inactive status while employed with the agency.)
  • Knowledge of general legal practices/procedures.
  • Paralegal certification
  • Knowledge of open government law (open records/public information)
  • Administrative law experience, include Administrative Procedures Act.
  • Work experience with paperless filing systems.
Knowledge, Skills and Abilities:
  • Knowledge of legal terminology
  • Knowledge of state and federal laws, rules, and regulations
  • Knowledge of research methods and techniques
  • Excellent oral and written communication skills.
  • Proficient skill in computer processing and databases.
  • Good organizational skills and an ability to prioritize and manage a caseload.
  • Ability to research, analyze, and apply statutes and rules.
  • Ability to successfully function as a team member and work well with all levels of co-workers and customers.
  • Ability to communicate professionally with the public both verbally and in writing.
  • Experience using office productivity software such as Microsoft Office to create documents, spreadsheets, meetings and manage email.
  • Experience working on a Microsoft Windows based computer in a networked environment
  • Experience with basic operation of web browsers such as navigation and searching
Environmental and Physical Conditions:

Normal office work environment, mostly sedentary in nature. Involves speaking to groups of people. May involve walking; standing; remaining stationary for long periods of time; pulling and pushing; kneeling, stooping and bending; and safely lifting and carrying items weighing up to 30 pounds. Work involves extensive phone usage and repetitive hand/wrist/finger motions while using the computer
