Job Summary:

The Deputy General Counsel provides legal counsel to the Texas Real Estate Commission (TREC).  This position works closely with the General Counsel to together prepare for all meetings of the appointed policy makers, provide legal analysis and drafts proposed laws, support policy changes directed by the Commission, and act as a legal resource and liaison to the Broker Lawyer Committee and all other TREC advisory committees.  The Deputy General Counsel works closely with the General Counsel to provide legal analysis and assistance to agency staff.

Minimum Education:
  • Graduation from an accredited law school with a J.D. or L.L.B. degree
  •  Licensed by the State Bar of Texas, in good standing
Experience:
  • Minimum of five years’ experience in the full time practice of law within the government, regulatory, or nonprofit sector
  • Minimum of three years’ experience working with legislative bodies, commissions, boards, or other advisory or governing bodies
Knowledge, Skills and Abilities:
  • Knowledge of real estate law, contracts, and brokerage related practices
  • Knowledge of legal principles, practices, and proceedings; of state and federal laws, regulations, and rules;and of agency administrative rules and regulations
  • Skilled at coordinating volunteer advisory boards
  • Ability to speak publicly and communicate effectively with diverse audiences
  • Ability to distill complex information into understandable language
  • Ability to manage through diplomacy and gain the respect of others
  • Ability to maintain effective professional relationships with personnel, policy makers and stakeholders
Preferred Qualifications:
  • Recent experience practicing law at a Texas state agency, real estate-related trade association, or similar organization
Job Duties:
  • Deputy General Counsel to the Texas Real Estate Commission (TREC)
  • Provide day-to-day legal advice to management of all divisions of TREC
  • Answer general legal questions of license holders related to The Real Estate License Act and TREC rules
  • Plan, implement, direct and coordinate legal assistance on the interpretation and application of agency regulations and state and federal laws
  • Conduct legal research and review and draft legal documents, briefs, memoranda, and other legal documents
  • Analyze actual or proposed changes in law or rules
  • Draft legal-related education and training materials for license holders
  • Prepare draft rules; coordinate rule development with affected parties
  • Administer the Real Estate Recovery Trust Account and the Inspection Recovery Fund
  • Serve as legal resource and liaison for TREC advisory committees

Environmental & Physical Conditions:  Normal office work environment, mostly sedentary in nature. May involve walking; standing; remaining stationary for long periods of time; pulling and pushing; kneeling, stooping and bending; and safely lifting and carrying items weighing up to 30 pounds. Work involves extensive telephone usage and repetitive hand/wrist/finger motions while using the computer.
